Welcome to Affable Foodie! These Terms and Conditions (“Terms”) govern your use of our website, services, and any related communications, agreements, or content provided by Affable Foodie (“we,” “us,” “our”). By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services

Affable Foodie provides digital marketing services including, but not limited to:

  • Social media strategy and management

  • Search engine optimization (SEO)

  • Website content creation

  • Email marketing

  • Paid advertising (PPC)

  • Photography and video content

All services are delivered according to the scope defined in the proposal or agreement signed by the client (“you,” “your”).

2. Client Responsibilities

You agree to:

  • Provide timely access to assets, logins, and brand information

  • Review and approve content or campaigns promptly

  • Notify us of any changes to your business that may impact the work

Delays caused by lack of client communication or incomplete materials may affect deadlines and results.

3. Payment Terms

Invoices are due according to the payment schedule outlined in your service agreement. Late payments may be subject to a 5% monthly late fee. Services may be paused or terminated if invoices are not paid within 30 days of the due date.

Unless otherwise agreed upon, all payments are non-refundable.

4. Intellectual Property

Unless otherwise stated in writing:

  • You retain ownership of all original materials you provide.

  • We retain the right to display non-confidential work for portfolio or promotional purposes.

  • Final approved content created by Affable Foodie is yours to use freely upon full payment.

Use of our work without payment constitutes copyright infringement.

5. Confidentiality

We will not disclose your private business information or login credentials to third parties without your consent. You agree not to disclose our proprietary strategies, pricing, or materials.

6. Termination

You may cancel services with 30 days’ written notice unless otherwise specified in your contract. We reserve the right to terminate services for non-payment, breach of these Terms, or abusive behavior.

Before termination or legal action is taken, both parties agree to attempt in good faith to resolve any disputes or breaches within 10 business days of written notice. This may include clarifying expectations, adjusting deliverables, or issuing partial refunds or credits where appropriate.

Upon termination, you will receive any completed work you have paid for, and any unpaid work will be billed accordingly. Affable Foodie may retain a reasonable portion of the total fee for work already performed, even if not delivered in full, unless otherwise agreed.

7. Limitation of Liability

Affable Foodie is not liable for:

  • Any indirect or consequential losses

  • Errors due to outdated, inaccurate, or missing information provided by the client

  • Changes to algorithms or third-party platforms beyond our control (e.g., Instagram, Google)

We do not guarantee specific results (e.g., #1 Google ranking, viral post) but commit to using best practices in good faith.

8. Revisions and Feedback

Each project includes a limited number of revisions as outlined in your proposal. Additional revisions may incur extra fees. We encourage clear and timely feedback to keep projects on track.

9. Website Usage

By using our website, you agree not to:

  • Misuse or interfere with the operation of our site

  • Repurpose, copy, or distribute content without permission

  • Upload malicious software or attempt to access restricted areas

We reserve the right to remove access or block users who violate these rules.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in the courts of Berks or Lancaster County, PA.

11. Changes to Terms

We may update these Terms from time to time. Updates will be posted to our website and are effective immediately. Continued use of our services indicates acceptance of any revised Terms.

12. Limitation of Liability and Remedies

Affable Foodie is not liable for:

  • Indirect or consequential losses (e.g., loss of income, followers, or reputation)

  • Errors due to outdated, inaccurate, or missing information provided by the client

  • Platform changes (e.g., algorithm shifts, policy updates) beyond our control

In the event of a dispute or dissatisfaction, your sole remedy is to request a revision, credit, or refund up to the amount paid for the disputed service. We aim to address all concerns professionally and constructively.
